Privacy Policy

TravelStorysGPS, LLC, a Wyoming limited liability company (“TravelStorysGPS,” “us,” or “we”) operates the web site located at http://www.travelstorysgps.com, and other sites where this Privacy Policy is displayed (each, a “Site”). TravelStorysGPS also provides access to the mobile application TravelStorysGPS (the “Application”).

This privacy policy (this “Policy”) discloses the ways in which we collect and use information from users of the services offered through the Sites or Application (collectively, the “Services”) both on our own behalf and on behalf of our customers and partners (our “Sponsors”). This Policy is intended to inform users of the Sites, Application and Services of the information collection and use practices applicable to the Site, Application and Services. We will not collect, sell, share, transfer, or use information other than as stated in this Policy.

Amendments to this Policy.

We may change this Policy at any time. If we change this Policy, we will notify users through a posting of the change to the Site or by way of an e-mail. Changes to this Policy will be effective upon the earlier of the date 30 days following the date we provide notification of the changes or the date on which you agree to the changes on the Site or through the Services. In any case, even if you have not been asked to agree to a change to this Policy, your continued use of the Services after 30 days following notification of that change will constitute your acceptance of the change. Unless we seek and receive your consent, we will use all information in accordance with the version of this Policy under which the information was last collected. Users may prevent their information from being used for purposes other than those for which it was originally collected by emailing us at support@travelstorysgps.com.

Third Party Web Sites and Platforms.

The Services enable users to interact with our Sponsors, third party service providers and other third party web sites and platforms. For example, the Services may enable users to submit personally identifiable information (and other information and content) to TravelStorysGPS and its Sponsors through the third-party mobile donation platform Give by Cell®, if a user chooses to give a donation. In addition, the Services may also enable a user to submit personally identifiable information (and other information) to Socialize® for distribution to the user’s Facebook® or Twitter® account. The third party web sites and platforms may include, by way of example, web sites and platforms operated by Sponsors and other customers, advertisers, or affiliates of TravelStorysGPS or by other third-parties.

You may be asked to provide personally identifiable information (or other information) to Give by Cell®, Socialize® or other third parties through these other web sites or through the Services (for example when you click on a link available through the Services to one of these other web sites or when you provide information through the Services). Give by Cell®, Socialize® and these other third parties maintain their own data collection and use policies and practices. This Policy covers only the data collection and usage policies and practices applicable to the Services and does not extend to Give by Cell®, Socialize® or any of these other third parties. If you do not want to share that information, you should not use the features of the Services associated with that third party.

TravelStorysGPS IS NOT RESPONSIBLE FOR THE POLICIES OR PRACTICES OF Give by Cell®, Socialize® OR ANY OTHER THIRD PARTIES. YOU SHOULD REVIEW THESE OTHER APPLICABLE PRIVACY POLICIES BEFORE PROVIDING THEM WITH ANY PERSONALLY IDENTIFIABLE INFORMATION.

Collection of Personally Identifiable Information.

Personally identifiable information includes information by which you may be personally identified, either directly or in combination with other information. We only collect and share personally identifiable information regarding users of the Services as described in this Policy. Except as noted in this Policy, personally identifiable information collected through the Services is NOT shared with third parties without your consent.

We may automatically collect personally identifiable information from you when you use or access the Site, Application or Services. We may also collect personally identifiable information from you through a number of voluntary sources, such as responses, registrations, surveys, reviews, comments, emails, postings, messages or other submissions and communications sent by you to TravelStorysGPS. The personally identifiable information we may collect from you will include, by way of example:

· Domain name and Internet Protocol (IP) address;

· Location information when using the Services;

· E-mail address;

· Public Twitter name;

· Contact information (including name, address, and zip code);

· Mobile phone number, mobile carrier’s name, and the date, time and content of mobile communications with the Site;

· User-specific and aggregate information on areas of the Services accessed;

· Username and password information for the Services; and

· Other information volunteered by you, such as information provided through postings, responses, registrations, surveys, reviews, comments, emails, photographs, messages or other submissions and communications sent by you to TravelStorysGPS or the Services.

You should not provide TravelStorysGPS with any personally identifiable information (or submit or post any personally identifiable information through the services) unless you would like that information to be used by TravelStorysGPS in accordance with this Policy. Likewise, you should not submit or post any personally identifiable information through the services unless you want that information to be accessible by other users of the services, as information posted through the services may be made available to other users of the services.

Personal Profiles.

We may also provide you with the ability to create a personal profile on a Site containing personally identifiable information provided by you and to make your personal profile available to other users of the Site or Services. You may adjust the scope and nature of the information you make available to other users of the Site or Services through your personal profile as indicated on the Site. you are responsible for the information Included in your personal profile and shared with other users of the Site and Services. You should not create a personal profile unless you want to share your personally identifiable information with other users of the Site Site and Services.

Use and Sharing of Personally Identifiable Information.

The personally identifiable information that we collect from users of the Site, Application and Services (both registered and unregistered) may be used and transferred to third parties for a variety of purposes.

The operation of the Services may require TravelStorysGPS to share and transfer your personally identifiable information to third parties. For example, TravelStorysGPS will share and transfer your personally identifiable information with the Sponsors to whom you have made a donation. We may also share and transfer content and personally identifiable information of users to third parties for other reasons as well, including by way of example:

· Customizing the content displayed on the Services and/or the layout of the Services for each individual user of Services;

· Notifying users about updates to and activities on the Services and about goods and services that we feel may be of interest to you;

· Improving the content of the Services, to analyze data and patterns regarding usage of the Services;

· Contacting users of the Services for marketing purposes;

· Contacting users of the Services for information verification purposes; or

· Administering and operating any contest, rewards program or sweepstakes offered on or through the Services, including but not limited to the winners of such contests and sweepstakes and recipients of rewards.

Submitting any content or other information through the Services will be considered your consent to “OPT IN” for the use and transfer of that content and information under this Policy.

Non-Personally Identifiable Information.

Where possible, our server automatically recognizes and collects certain non-personally identifiable information regarding users of the Services, including, by way of example, IP address, browser type, and other information regarding the system and connection of each visitor or user. We also collect information about how visitors access and use the Services, including, by way of example, what pages, features or portions of Services are used. We may collect this information directly, or through a third party service provider acting on our behalf to operate the portions of the Site or provide portions of the Services (see “Consent to the Use of Third Party Providers” section below). This information allows us to improve the content of the Services, facilitate research and analysis of the Services, and develop and refine our Services. Sometimes, we utilize the services of a third party to help us understand this information better, although the information that is disclosed to these entities remains at all times in anonymous and non-personally identifiable form.

Disclosures Required by Law.

Though we make every reasonable effort to preserve user privacy, we may need to disclose personally identifiable information of certain users of the Services when we have a reasonable and good-faith belief that the disclosure is necessary to enforce the terms of use applicable to that portion of the Services, comply with a judicial proceeding, court order or other legal process, or to otherwise enforce or protect our rights under applicable law, including, without limitation, our intellectual property rights. In this situation we will use reasonable efforts to provide notice of this disclosure to all affected users, to the extent reasonably possible under the circumstances.

Enhancement of Information.

We may combine and enhance the personally identifiable information (and other information) we collect with other third party data and information. For example we may enhance the information we collect to better target advertising and provide pertinent offers in which we think our users would be interested. Give by Cell®, Socialize® and our Sponsors may provide us with personally identifiable information (and other information) they collect either through the Services or directly from you outside of the Services. We may also enhance the information we provide to our customers and Sponsors regarding users that provide responses, comments, postings, messages or other submissions or communications through the Services.

Service Announcements.

On occasion it is necessary to send out service related announcements. For instance, if any of the Services are temporarily suspended for maintenance we might send users an email. Generally, users may not opt-out of these communications, though they can deactivate their account. These communications are not promotional in nature.

Special Offers and Updates.

We may send new registrants of the Services a welcoming email to verify password and username. Established members may occasionally also receive information on products, services and special deals, and periodic newsletters. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice and Opt-out section.

Customer Service.

We communicate with users to provide requested services and with regard to issues relating to their account. We reply to communications via email, in accordance with the users’ wishes. You may not opt-out of these communications if you would like to use the Services.

Choice and Opt-out.

We provide you with a choice whether to receive certain emails and other communications through the Services.

We provide you the opportunity to ‘opt-out’ of having your personally identifiable information used for certain purposes. If you are a user of the Services and you no longer wish to receive emails from us or have your email address shared with third parties, you may opt-out of receiving email from us or having your email address shared with third parties.

All opt-out requests can be made by emailing us at support@travelstorysgps.com, calling us at (307)733-8673, writing us at TravelStorysGPS 4445 Moose Wilson Road, Wilson, WY 83014, or using the unsubscribe feature available in our communications.

Access, Review, Update.

The users of the Services should email us at support@travelstorysgps.com to review, delete, deactivate, update or change any personal information that was previously provided to or collected by TravelStorysGPS.

California Privacy Rights.

California law provides that California residents have a right to request that businesses tell them how their personally identifiable information has been shared with third parties for those third parties’ direct marketing purposes. However, there is an exception to this requirement for businesses that have adopted and disclosed, in their privacy policy, a policy of not disclosing a person’s personally identifiable information to third parties for those third parties’ direct marketing purposes if that person has exercised an option to opt-out of the disclosure of their personally identifiable information to third parties for such purposes.

TravelStorysGPS has adopted a policy of allowing you to opt-out of the disclosure of your personally identifiable information to third parties for their direct marketing purposes and thus falls within this exception. Instructions for opting out can be found in the section above entitled “Choice and Opt-Out.”

Children.

The Services are not directed to children under 13 years of age. TravelStorysGPS does not knowingly solicit or collect personal information from children under 13 years of age.

Cookies.

“Cookies” include commonly used pieces of information in the form of small files that are placed on an individual’s computer hard drive to enable the individual to more easily communicate and interact with the Services. We may use cookies for various purposes, including, by way of example:

· Saving user preferences;

· Customizing content of the Services for individual users;

· Recording session information;

· Saving certain information about users of the Services; and

· Facilitating and enhancing interaction with the Services.

TravelStorysGPS does not use cookies to retrieve information from a computer that is unrelated to TravelStorysGPS or the Services.

A cookie does not collect or keep your name or other personally identifying information; however, we may link the information obtained through cookies to other personally identifiable information to give us a better understanding of your preferences, so that we can provide a more meaningful experience to you through the Services.

We may also use a third party provider to analyze data and patterns regarding usage of the Services. This third party provider may use cookies or web beacons to collect such information.

Most browsers will allow you to erase cookies from your computer hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. You may also be able to refuse certain web beacons by adjusting the settings on your browser or email software. Please refer to your browser or email software instructions or help screen to learn more about these functions.

Consent to Use of Third Party Providers.

In addition to the specific third parties noted in this Policy, we may also contract with other third parties to provide various services to us relating to the Services on an outsourced basis rather than performing the services itself. For example, we may contract with a web site hosting provider to host all or a portion of the Services. We may also contract with third party mobile providers to enable the mobile user services provided through the Services. By using the Services, all visitors consent to TravelStorysGPS providing both personal and non-personal information to these third party providers for the purpose of enabling the third party provider to provide these outsourced services to TravelStorysGPS. In addition, all visitors consent to the collection, maintenance, and processing of their personal and non-personal information by TravelStorysGPS and these third party providers.

Consent to Transfer of Information.

If we elect, in our reasonable discretion, to transfer ownership or control of the Services (or the Site or an Application) to a third party, whether or not in the context of an acquisition of TravelStorysGPS or a merger of TravelStorysGPS with a third party, you consent to the transfer of your personally identifiable information and non-personally identifiable information by TravelStorysGPS to that third party, provided that all use of your information by that third party remains subject to the terms of this Policy.

Security.

We will use at least industry standard security measures on the Services to prevent the loss, misuse and alteration of the information under our control. While there is no such thing as “perfect security” on the Internet, we will take reasonable steps to insure the safety of your personal information.
